Compliance documents

As qualified lawyers, we will attend to the preparation of the Section 32 Vendor's Statement and all sale documents, to ensure your compliance with the Sale of Land Act 1962 and other laws applicable to the sale of real estate.

 



Making documents available to purchasers

The Section 32 Vendor's Statement can be downloaded from our website, together with our "Bid to Buy" form. Effectively, a potential purchaser is able to access the sale documents at any time, 24 hours a day, seven days a week. We can also post, fax or email contracts to purchasers or their lawyers upon request.

 



Contract preparation

When negotiations have concluded, and you have decided to sell your property to bidder offering the best price, we will prepare your offer to the purchaser on your behalf. We use the standard form Contract of Sale of Real Estate as prescribed by the Estate Agents (Contracts) Regulations 2008.

We will conclude the sale, and liaise with the purchaser's legal representative throughout the conveyancing stage, and ensure that the contract and the terms of the sale are observed until final settlement.

 



Execution of sale documents

The flexibility of our sale process means that a property can be sold, even though the two parties may be many kilometres apart.

Example:

A client whose property was on the market had to travel through outback NSW.

While he was away a purchaser submitted a bid on his property. We contacted the client on his mobile telephone, and explained the bid and the special conditions required by the purchaser. The client decided that the bid was acceptable, but he was still travelling, and would be unable to return to Melbourne for another week.

We advised the client that he could have us prepare the contract, and we would fax it to the post office in the nearest town. The client travelled on until he reached the next town, then contacted us from the local post office and gave us the the post office's fax number. We faxed the contract to the client, he signed it, and faxed it back to us. We arranged for the purchaser to sign the contract, and the property was sold.


 



Costs

The costs of legal documents associated with a standard sale of real estate are included in our fixed-fee. Additional costs will be generated only at the direct request of the client.

Circumstances where additional costs may be applicable include:

  Where the transaction involves very unusual matters, requiring the preparation of special documents.
  Where a purchaser resides overseas, and requires documents to be sent by FedEx or courier etc.
