As a qualified professional, your lawyer is able to perform all legal work required to effect the sale of your property. This includes the giving of legal advice throughout the sale transaction.

Conveyancing work is just one small part of the real estate sale transaction.

Most consumers are not aware that conveyancing work does not commence until after the sale has taken place. Your lawyer is fully qualified to perform all conveyancing work associated with the sale of real estate.



We ensure legal compliance

While this topic can be regarded as part of the legal work associated with a sale, we believe that it requires separate attention.

Ensuring legal compliance involves our taking responsibility for the vendor's legal obligations under a variety of laws and regulations. It means that the vendor can rely on us to point out when owner-builder disclosure obligations apply, when the requirement for public liability insurance in the name of the body corporate can make the difference between a safe sale and one that is voidable at any time until settlement, or when payment arrangements amount to "vendor terms" and introduce further compliance issues.

Being mindful of our vendor clients' legal obligations is just one of the reasons why our sale procedure calls for the use of experts at every stage.



Costs

The costs of all legal work associated with a standard sale of real estate are included in our fixed fee. Additional costs will be generated only at the direct request of the client.

Circumstances where additional costs may be applicable include:

  Preparation of documents not ordinarily required in a standard sale, such as a Power of Attorney or a Will.
  Legal work associated with a breach of the sale contract and enforcement of your rights (these can often be claimed from the defaulting party).
  Non-standard or additional legal work generated by your lender (legal work associated with the discharge of a mortgage or withdrawal of a caveat over the sale property is a normal requirement, and is included in our standard fixed fee).
